Server logfiles

By visiting our website through the program used by the visitor to display websites (the so-called “web browser” or just “browser”), which the user has installed on the device he is using, the following information is transmitted to our web server: the IP address of the requesting terminal (the last two digits of the IP address are truncated), date and time of visiting our web pages, indication of the time difference between requesting host and web server, details of the request or specification of the retrieved file that has been sent to the user access status (successful transmission, errors etc), amount of data transferred in bytes, the website from which the user accessed, the browser used by the user, the operating system, the interface, the language of the browser and the version of the browser software.
This information is stored on our web server in a so-called log file (in a “logfile”). Due to the shortened IP address, it is not possible for us to establish a personal reference.
Storage in log files is done to ensure the functionality of the website. In addition, the data is used to optimize the website and ensure security. An evaluation of the data for marketing purposes does not take place in this context. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.
The log files are stored for a period of 190 days.

Use of a Security Plugin

This website uses the security plugin Wordfence Security provided by Defiant Inc., 800 5th Ave, Suite 4100, Seattle, WA 98104, USA.
Wordfence protects our website against unauthorized access, attacks, malware, brute-force attacks, and other security-relevant activities. To do this, Wordfence analyzes, among other things, access to the website and can detect and block suspicious or malicious requests.
As part of these security functions, the following data may be processed in particular:

• IP address of the accessing device,
• where applicable, the proxy IP address,
• the URL accessed,
• technical information from the HTTP header,
• technical data of the HTTP request,
• in the event of security-relevant incidents, additional technical information,
• for logged-in users, where applicable, username and email address.

This processing is carried out to safeguard our legitimate interest in the security and reliable operation of our website in accordance with Art. 6(1)(f) GDPR. Our legitimate interest lies in particular in detecting and repelling attacks, investigating security breaches, and protecting the website against misuse.

Wordfence may transmit security-relevant data to Defiant Inc. in the USA and process it there. According to its own statements, Defiant uses the Standard Contractual Clauses (SCCs) provided by the European Commission, along with additional appropriate safeguards, for the transfer of personal data to third countries.

The data protection and data processing terms provided by Wordfence (Data Processing Addendum) apply between the operator of this website and Defiant Inc. These terms establish that, with respect to the personal data concerned, the operator of this website acts as controller and Defiant Inc. acts as processor.

Real-Time Wordfence Security Network

The Real-Time Wordfence Security Network is activated on this website.
This allows Wordfence to process security-relevant information about attack attempts and transmit it to the Wordfence infrastructure. This may include, for example, information about failed login attempts, access to known malicious URLs, and access by already-blocked IP addresses.
In return, the website may receive information about known or currently conspicuous attackers in order to detect and block attacks more quickly.
The legal basis for this processing is Art. 6(1)(f) GDPR. Our legitimate interest lies in ensuring the security of our website, defending against attacks, and preventing misuse. This processing serves these purposes exclusively and is limited to security-relevant information.

Retention Period

Security-relevant access data in Wordfence Live Traffic is stored for a maximum of 30 days and automatically deleted thereafter.
For personal data transmitted to and processed by Defiant Inc. as part of the Wordfence services, the retention period is governed by the data protection and data processing terms in place between us and Defiant. Under the current Data Processing Addendum, personal data is generally retained for the duration of the agreement plus an additional one month, unless otherwise agreed in writing. The data is then deleted or anonymized, unless statutory retention obligations or other legally permissible grounds require longer storage.

SMS Newsletter “Marc Miner telegram”

The Marc Miner telegram contains information about my music, events and merchandising. We use the third-party service websms for communication. When you use our SMS service, the following data will be stored about you: mobile phone number, messages sent and (optionally) first name. This data is used exclusively for messenger communication and is not transferred to third parties for use.

The registration form optionally offers the first and last name so that we can address the newsletter recipients personally.

Push notifications from PushPanda.io

We use PushPanda.io browser push notifications. Browser push notifications are messages that can be displayed on your device without opening the website or the respective app.

No unique user data such as IP addresses, which can lead to the respective user, are stored. When entering (opt-in procedure) in the notification distributor, only an identification key and the geographic IP information (country and state) of the user are transmitted and stored in the PushPanda.io database. This key is assigned by the respective browser manufacturer (Google, Mozilla, Apple, etc.) and enables the notifications to be sent to the respective browser later. The sending process takes place directly through the browser manufacturer.

If the opt-in for push notifications is withdrawn (opt-out), all data stored at PushPanda.io will be deleted and the identification key will become invalid.

Order process

In case of registration we collect and process the following personal data of the user: title, first and last name, e-mail address and location details for the purpose of providing access to services and usage of services. By registering and providing the personal data listed, you consent to the processing of the data for the stated purposes.
You can revoke your consent to the processing of personal data at any time by email to info@marcminer.com, which will result in the deletion of your personal data and deactivation of the account.
The personal data collected by us will be passed on to the transport company commissioned with the delivery as far as this is necessary for the delivery of the goods.
We store the data required for contract execution until the expiry of the statutory warranty and, if applicable, contractual warranty periods.
The legal basis for this processing is Art. 6 Para. 1 b) GDPR.

Paypal

Our onlineshop uses PayPal components. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which represent virtual private or business accounts. PayPal also has the option of processing virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an email address, there is no classic account number. PayPal makes it possible to initiate online payments to third parties or to receive payments. PayPal also acts as a trustee and offers buyer protection services.

When selecting “PayPal” as payment option during the ordering process in our online shop, the data of the person concerned is automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data required for payment processing.
The personal data transmitted to PayPal is usually first name, last name, address, email address, IP address, telephone number, mobile phone number or other data that are necessary for payment processing. In order to process the purchase contract, personal data related to the respective order are also necessary.
The purpose of the transmission of the data is to process payments and prevent fraud. The controller will transfer PayPal personal data in particular if there is a legitimate interest in the transfer. The personal data exchanged between PayPal and the person responsible for processing may be transmitted by PayPal to credit reporting agencies. The purpose of this transmission is to verify identity and creditworthiness.
PayPal may pass on the personal data to affiliated companies and service providers or subcontractors, in case this is necessary to fulfill the contractual obligations or the data needs to be processed in the order.
Responsible persons have the option of withdrawing their consent to the handling of personal data at any time from PayPal. A revocation does not affect personal data that must be processed, used or transmitted for (contractual) payment processing.

We operate social media sites to promote our services, events and promotions. The processing of the personal data of users is thus based on our legitimate interests (Article 6 (1) lit. DSGVO).
You have the right to request information about which data is processed (Art. 15 GDPR), to complete incomplete data as well as to have incorrect data corrected or deleted (Art. 16, 17 GDPR). A right of cancellation does not exist if the processing is necessary to fulfill a legal obligation or to assert, exercise or defend legal claims. Under certain circumstances, you may also request the restriction of the processing of your data (Art. 18 DSGVO) as well as the processing of your data (Art. 21 DSGVO). You have the right to receive the data that you have provided in a structured, common and machine-readable format and to transmit this data to another person responsible (Art. 20 DSGVO).
If your data is processed on the basis of your consent, you have the right to revoke this consent at any time. The revocation does not affect the legality of the data processing up to this revocation.
